Trump DOJ Obtained Data on Schiff and Swalwell, Two Long-Time Champions of Domestic Spying, by Glenn Greenwald

The Trump Justice Department in 2017 and early 2018 issued subpoenas to Apple to obtain the communications records of at least two Democratic members of the House Intelligence Committee, Reps. Adam Schiff (D-CA) and Eric Swalwell (D-CA). According to The New York Times, DOJ prosecutors attempting to determine who leaked classified information to the media about Russiagate suspected the two House Democrats were the culprits, and to prove that, they obtained their communications records as well as those of family members, including minor children.

A DOJ leak investigation aimed at sitting members of Congress is highly unusual. Both the Obama and Trump administrations, in a hunt for leakers, created controversy by obtaining the communications records of journalists, including — in the case of the Obama DOJ — the family members of those journalists. But investigating members of the House Intelligence Committee for leaking crimes — as opposed to corruption or other standard criminal charges — can present different dangers. Neither Congressman was charged with any crimes and the investigation reportedly bore no fruit.

The two House Democrats, among the most fanatical disseminators of baseless Russiagate conspiracies and long known to serve as anonymous sources of leaks to liberal media outlets, reacted with predictable outrage. “This baseless investigation, while now closed, is yet another example of Trump’s corrupt weaponization of justice,” Schiff intoned on Thursday night. As difficult as it is, Swalwell, as he often does, found a way to be even more melodramatic than Schiff: “Like many of the world’s most despicable dictators, former President Trump showed an utter disdain for our democracy and the rule of law.”

Is Eric Swalwell The Answer To Trump’s Prayers? by Jonathan Turley

Below is my column in The Hill newspaper on the complaint filed by Rep. Eric Swalwell against former president Donald Trump. Swalwell just filed a complaint that could prove to be the vindication that Trump has long sought in the riot in the Capitol on January 6th.

Here is the column.

French philosopher Voltaire said he had only one prayer in life — “O Lord, make my enemies ridiculous” — and that it was uniformly granted by God. The answer to Donald Trump’s prayers may be Rep. Eric Swalwell (D-Calif.). It is not because of Swalwell’s relationship with a Chinese agent or the bizarre defenses of him, including one Democrat insisting he deserved the Medal of Honor. It is because Swalwell’s lawsuit against the former president could offer Trump the ultimate vindication over his role in the Jan. 6 riot on Capitol Hill.

Swalwell’s 64-page complaint against Trump — along with son Donald Jr., Rudy Giuliani, and Rep. Mo Brooks (R-Ala.) — alleges nine counts for relief, from negligent emotional distress suffered by Swalwell to negligence in the “incitement to riot.” One might think this would be a lead-pipe cinch of a case. After all, an array of legal experts has insisted for months that this was clear criminal incitement, not an exercise of free speech. As a civil lawsuit, it should be even easier to win, since the standard of proof is lower for civil cases.

Yet, for more than four years, many of these same experts claimed a long list of “clear” crimes by Trump that were never prosecuted or used as a basis for impeachment. Likewise, despite similar claims of criminal incitement, roughly three months have passed without a criminal charge against Trump. District of Columbia Attorney General Karl Racine insisted weeks ago that Trump’s alleged crime would be investigated. Yet any such prosecution likely would collapse at trial or on appeal, and people like Racine are not eager to prove Trump’s case.

Is the Media Burying The Swalwell Story? by Jonathan Turley

Eric Swalwell is one of the slimier pieces of garbage who populate the Democrat party, and that’s saying something. From Jonathan Turley at jonathanturley.com:

We often discuss media coverage and accuracy on developing legal and political controversies.  Much of this discussion recently has focused on the bias shown by the media in the last four years. I have worked for the media as a legal analyst and columnist for years, but I have never before seen this raw and open bias in major media. At the same time, academics are rejecting the very concept of objectivity in journalism in favor of open advocacy.

This morning, Fox News called out all of the networks for zero coverage of the bombshell story from Axios that Rep. Eric Swalwell may have had a close relationship with a suspected Chinese spy who fled to China a few years ago.  Many of us were struck by the lack of coverage, particularly given the position of Swalwell on the House Intelligence Committee and his former bid for the presidency. It was particularly striking when the media is now reluctantly covering the Hunter Biden story after a long blackout before the election. Yet, the most stark comparison is with the exhaustive coverage given the highly analogous story involving an alleged spy, Maria Butina, who had an affair with a high-ranking figure in the National Rifle Association.

Swalwell is alleged to have had a close relationship with Chinese national, Fang Fang or Christine Fang, who not only raised money for him but placed at least one intern in Swalwell’s congressional office, according to Axios. Bizarrely, Swalwell has refused to confirm or deny that he had an intimate relationship with his office claiming that such an answer could compromise classified information. Even that ridiculous comment did not prompt ABC, NBC, or CBS to cover the story. Obviously, Fang and the Chinese already know if she had a sexual relationship with Swalwell. The only people in the dark are the voters.

There are ever more creepily subtle ways politicians insinuate gun control and eventually confiscation into American life. From Jeremiah Johnson at shtfplan.com:

As a review of some of the current events that have been taking place in the U.S. recently, on 11/5/18, Anne Arundel County Police in Maryland shot and killed a man as they attempted to exercise a “red flag” gun removal order. Those “red flag” orders went into effect on October 1 of this year. Let’s take the definition of this new “game” directly from Wikipedia and examine it:

A red flag law is a “gun violence protection” law that permits police or family members to petition a state court to order the temporary removal of firearms from a person who may present a danger to others or themselves. A judge makes the determination to issue the order based on statements and actions made by the gun owner in question. After a set time, the guns are returned to the person from whom they were seized unless another court hearing extends the period of confiscation.  Such orders are known as “Extreme Risk Protection Orders” (ERPO) in Oregon, Washington, Maryland, and Vermont, as “Risk Protection Orders” in Florida as “Gun Violence Restraining Orders” in California; as “risk warrants” in Connecticut; and as “Proceedings for the Seizure and Retention of a Firearm” in Indiana.
