Below is my column in The Hill on recent reports of grand jury testimony in the Durham investigation. The implications of the grand jury — and the eventual report — have rattled folks in the Beltway this week . . . for good reason.

This week Texas Rangers infielder Brock Holt became a baseball legend when he went to the mound and threw an “eephus,” a high-arching, off-speed pitch, in a game against the Athletics. It is believed to be the slowest pitch recorded in MLB history, and A’s batter Josh Harrison stood in disbelief as the 31 mph pitch was called a strike. Harrison just laughed in amazement.
Pirates outfielder Maurice Van Robays coined the term in the 1946 All-Star Game, explaining, “Eephus ain’t nothing, and that’s a nothing pitch.” But as Holt demonstrated, sometimes a “nothing” slow pitch can amount to a great deal.
That is equally true about the occasional criminal eephus that takes everyone by surprise. For example, U.S. Attorney John Durham’s investigation has been slow in coming, but on Friday, a report surfaced that he is pitching evidence to a grand jury in an investigation started back in May 2019. The Durham investigation is now longer in duration than former special counsel Robert Mueller’s investigation, and many people long forgot that Durham — made a special counsel at the end of the Trump administration — was even still in the game.
The report in The Wall Street Journal said Durham is presenting evidence against FBI agents and possibly others in the use of false information or tips at the start of the Russia investigation in 2016. Those “others” could include a virtual who’s who of Washington politics, and even if they are not indicted, Durham could implicate some of the most powerful figures in politics in his final report, expected in the coming months.

Republicans on the Senate Judiciary Committee say they want to know if President Joe Biden’s nominee for Attorney General Merrick Garland will allow Special Counsel John Durham’s investigation into the origins of the Federal Bureau of Investigation’s Crossfire Hurricane probe to continue. “I have no reason to think he should not remain in place,” Garland told Sen. Chuck Grassley Monday.
In reality, if confirmed Garland will not allow Durham to stay in place, never mind issue a report. The prospect that Biden’s attorney general might allow Durham to indict former Barack Obama administration officials is ludicrous. Remember that documents released over the last year gave evidence that as vice-president Biden was not only aware of the spying operation against Trump officials but participated in it. Biden not only knew that the FBI was framing incoming National Security Advisor Michael Flynn but suggested that the Department of Justice might charge Flynn for violating the Logan Act.
In other words, the FBI officials that Durham is reportedly investigating are Biden’s co-conspirators. To allow them to be indicted would not only point to Biden’s guilt but also show that the most powerful man in the world is unable or unwilling to protect allies who have helped advance the cause of the party he now leads. That would show Biden to be weak. Garland understands that his primary duty as Biden’s chief law enforcement officer is not to oversee the fair and equal treatment of all Americans under the law, but to protect the president and the party he serves. Regardless of whether or not John Durham is a “special counsel,” if Biden assumes the presidency all the investigations of Deep State efforts to depose Trump are down the drain. From Chris Farrell at gatestoneinstitute.org:
- Should Biden finally, officially, be declared the next president, you can rest assured that he will dismiss Durham during the opening flurry of activity from his administration.
- Of course, this is all wildly frustrating for those of us hoping for some semblance of accountability and justice. Something. Anything.
- When the Russia! Hoax fell apart it was reinvestigated by Mueller – and when that collapsed, they manufactured “Ukraine!” This bit of theater got the president impeached in two months flat. That was just last year. Do you remember? For many eager to bring down the current administration, prosecutions and justice move with lightning speed. Barr and Durham appear to still be looking for the keys to their offices.
- This should all be deeply disturbing to the American public. Apparently, it is not. That, dear reader, is even more disturbing. The American public do not want to be deceived – yet again.

On Tuesday Barr poured cold water on President Donald Trump’s allegations of voter fraud, announcing that the Justice Department had found no fraud “on a scale that could have effected a different outcome in the election”). Of no less importance for the longer run, Barr seems to have abandoned the effort to hold top former Justice, FBI, and CIA officials (read National Security State) accountable for using their “Russia-gate” schemes to undermine Trump – both as candidate and president.
The one-and-a-half-year investigation led by US Attorney for Connecticut John Durham, appears dead in the water, floating next to the Trump ship – and sinking. Barring the unforeseen, what seems already clear is that the National Security State (aka, Deep State) will prevail yet again – this time, big time. Thus, for the foreseeable future, it will have few compunctions about interfering on the Washington political scene to nudge important things in the direction it wants – with not a thought to ever being held accountable. (For the record, Durham has charged only one person, an FBI lawyer who doctored an email relating to an application for a Foreign Intelligence Surveillance Act warrant.)
But wait, you say: the New York Times reports that Barr made an artful move in appointing Durham “Special Counsel”, which the Times says “makes it more difficult for the Biden administration to fire him”, and is “a move certain to please Mr. Trump.” That may be, but only if the president continues to heed the legal insight of the likes of Rudy Giuliani.

Obama administration officials committed crimes against the constitution. They engaged in a seditious conspiracy to overthrow the government of the United States.
James Howard Kunstler asks a lot of good question, and wonders if William Barr, James Durham, and James Huber are taking a dive on their investigations (SLL predicted they would). From Kunstler at kunstler.com:

Alexander Vindman and House Intel Committee chair Adam Schiff, records of CIA prop Stephan Halper’s doings with the Pentagon’s Office of Net Assessment, all communication records between State Department official Jonathan Winer and British ex-spy Christopher Steele….

Is Clinesmith the loose thread whose plea and singing to the Feds unravels the whole sweater of the attempted coup? Don’t hold you’re breath, but it’s not impossible, either. From Charles Lipson at realclearpolitics.com:
News reports have downplayed the significance of former FBI lawyer Kevin Clinesmith’s guilty plea, acknowledging he altered an official document in the government’s Trump-Russia collusion probe. There has been some coverage, mainly because it is so rare to see FBI agents charged with a felony and because it is the first tangible result of U.S. Attorney John Durham’s sprawling investigation of the investigators. But mainstream news outlets have minimized its importance. It’s only one count, they say, and it deals with a relatively minor crime by a mid-level figure.
That’s spin, and it’s wrong. This plea is like finding water seeping from the base of a dam. The problem is not one muddy puddle. The problem is that it foreshadows the dam’s failure, releasing a torrent. That’s what the Clinesmith plea portends.
What Did Clinesmith Admit?
Clinesmith acknowledges he altered an email from the CIA to the FBI, answering a question about Carter Page. Page is an American citizen and a Naval Academy graduate who spent considerable time in Russia. His time abroad raised a question for the FBI’s counter-intelligence division. Was Page a Russian agent? Or was he on our side, helping the U.S. gather intelligence about the Kremlin? The CIA would know.
The answer mattered because the FBI and Department of Justice were preparing warrants to spy on Page as a hostile foreign agent. The CIA gave them a clear answer in August 2016, before the first warrant was issued: Page was working for us. That answer was given to a still-unnamed FBI case agent, and we don’t know what he did with it. Did he show it to those preparing the warrant applications? Why else would he even ask the CIA for the information?
In 2017, after Clinesmith was tasked to the Mueller investigation, their team asked him to clarify Page’s relationship with U.S. intelligence. That’s when he took the CIA document and added a single word, “not.” The altered document said Carter Page was not a CIA asset. It was a deliberate lie.

While much speculation inside the Beltway says U.S. Attorney John Durham will punt the results of his so-called Spygate investigation past the election to avoid charges of political interference, sources who have worked with Durham on past public corruption cases doubt he’ll bend to political pressure — and they expect him to drop bombshells before Labor Day.
AG William Barr was asked, “Under oath, do you commit to not releasing any report by Mr. Durham before the November election?” His reply: “No.’
Durham’s boss, Attorney General Bill Barr, also pushed back on the notion his hand-picked investigator would defer action. Under Democratic questioning on Capitol Hill last week, he refused to rule out a pre-election release.
“Under oath, do you commit to not releasing any report by Mr. Durham before the November election?” Rep. Debbie Mucarsel-Powell (D-Fla.) asked Barr, citing longstanding Justice Department policy not to announce new developments in politically sensitive cases before an election.
“No,” the attorney general curtly replied.
Justice Department policy prohibits prosecutors from taking overt steps in politically charged cases typically within 60 days of an election. Accordingly, Durham would have to make a move by the Friday before Labor Day, or Sept. 4.
A low-profile prosecutor, Durham has kept a tight lid on his investigation into the origins of the specious Russiagate investigation of Donald Trump and his 2016 campaign, leading to rampant speculation about who he might prosecute and whether he would take action ahead of the Nov. 3 presidential election.
The man charged with investigating the origins of Russiagate is expanding his investigation. That’s not good news for a lot of former Obama operatives. From Tyler Durden at zerohedge.com:
Durham, the U.S. Attorney for Connecticut tasked with by Attorney General Bill Barr with investigating the actions taken against the Trump team, has tapped Jeff Jensen – U.S. attorney for the Eastern District of Missouri who had been investigating the Michael Flynn case. Also added to the team is interim U.S. Attorney for the District of Columbia, Timothy Shea, according to Fox‘s sources.
“They farmed the investigation out because it is too much for Durham and he didn’t want to be distracted,” said one source, adding “He’s going full throttle, and they’re looking at everything.”
We’ll believe John Durham’s investigation will lead to something substantial when a James Comey, John Brennan, Barack Obama, or Hillary Clinton is sentenced to prison. Don’t hold your breath. From Sara Carter at saracarter.com:
Department of Justice appointed federal prosecutor John Durham’s expanded criminal probe into the FBI’s investigation into President Donald Trump’s campaign is focusing on a slew of government documents that surfaced during the first several months of Trump’s presidency. The documents, which are being kept close hold, were hinted at by Attorney General William Barr in an interview he did with NBC in December and reported on by CBS News Friday.
On Friday, Catherine Herridge senior national security reporter with CBS first reported that a ‘strong paper trail’ of documents is being reviewed by Durham. Those documents span a time period from January, 2017 until May 2017, just before the appointment of Special Counsel Robert Mueller.
However, Barr has already suggested at the expansive nature of Durham’s probe in December and hinted at the discoveries. And in October, 2019 reports revealed that Durham had expanded the scope of his investigation and would investigate not only the origin of the bureau probe into Trump’s campaign but also the post-election timeline.
Barr said in an interview with NBC in December, that Durham “should spend just as much attention on the post-election period” noting that the probe will not just focus on the origins of the investigation.
Barr said he asked Durham to look at the post Trump election because “of some of the stuff that Horowitz has uncovered which to me is inexplicable.”
