Yesterday The American Spectator published my article about the legal peril confronting Kyle Rittenhouse in the aftermath of his acquittal. In it, I recommended that Rittenhouse keep his mouth shut, stay out of the public spotlight, and prepare for legal challenges to come.

Not guilty on all counts. That was the verdict by a courageous Kenosha, Wisconsin, jury in the unwarranted prosecution of Kyle Rittenhouse.

It had been obvious from the beginning to non-deranged and fair-minded persons who had viewed the widely broadcast video evidence that Rittenhouse had shot his three assailants in self-defense. The prosecution’s decision to charge him with murder and assault was mystifying. At least until we got a look at the bizarre, inept, and straw-grasping performance by the desperate, flop-sweating prosecutors sent into the courtroom to convict Rittenhouse. They appeared to be social justice warriors with law degrees and a tenuous grasp of reality who were on a mission to win at all costs — evidence be damned.

Well, speaking as one old prosecutor to a couple of shave tails, I hope you boys learned a lesson. Torturing facts and trying to pull fast ones on the defense gets you only so far before reality and common sense take over and bite you in the derriere.

Once again, a baseless and largely fictitious media narrative disintegrated when it collided with the facts of the case. Nevertheless, given the threats of violence if Rittenhouse was acquitted, he was at grave risk of conviction right up until the jury spoke.

For now, the young man is free of criminal charges, but, legally speaking, where does he go from here?

Let’s start with the state charges of which he has just been acquitted. Some benighted leftist die-hards are demanding that the prosecution appeal the jury’s verdict. But, under our laws, there is no appeal from an acquittal. Period. The state case is over.

But what about double jeopardy? Does the acquittal in state court preclude our woke Justice Department — under the fearless leadership of Attorney General Merrick (“The Hammer of the PTA”) Garland — from bringing federal charges? It does not. Under our system of dual sovereignties, an acquittal in state court does not bar federal charges arising out of the same facts. For example, when the police were acquitted in state court for beating Rodney King, they were subsequently convicted in federal court for violating his civil rights. Same beating, different courts, and different legal results.

Why They Hate Us, by The Zman

The left assumes that their opponents are as easily manipulated by propaganda as their own followers are. From The Zman at theburningplatform.com:

Back in the Bush years, the slogan they liked to use regarding their race policies was “the bigotry of low expectations.” An army of people no doubt spent months conjuring the slogan and field-testing it with audiences to make sure it hit the mark. They made sure it was completely anodyne while conveying the required adherence to left-wing morality regarding race. The slogan said George Bush cared while also saying the Democrats were the real racists.

In fairness to the civic nationalists, they have a point about the Left when it comes to the issue of race. Despite all the talk about racial justice, they talk about nonwhites as if they are children. For example, they literally argue that black people are incapable of acquiring a picture ID. Even if you want to limit that claim to the population that is dependent on the state, this claim is never made about the whites. You can forgive civic nationalists for being a bit rustled by this.

Putting that aside, there is another element to that old slogan. The underlying claim is not just that the Left treats nonwhites like children but that the Left assumes the nonwhites lack agency and therefore cannot be held accountable. This is not a small thing to say. It goes behind the hoary clichés about racism and speaks to how the Left sees themselves and the world. They see themselves as the puppet masters and the rest of us are just the puppets.

Kyle Rittenhouse has been found not guilty on all counts. And the lefties are insane with rage. Many are convinced that the case was about race and nothing else, and that the acquittal is proof of white supremacy.

Here’s a 30-second summary of what actually happened. After a white policeman in Kenosha, Wisconsin shot a black criminal – in what was later found to be justified use of force — Rioters and arsonists went to work. Police held back, and this is all that was left of a Prisons Department building. Here is used-car dealer, Car Source, after arsonists torched it. Kyle Rittenhouse, who has close ties to the city, was outraged. On the third day of the riots, he was asked to protect the Car Source lot, together with several other armed men.

He also took a first-aid kit and treated several people who were injured.

The rioters, who had had such fun looting and burning, were furious when men with rifles showed up, putting out fires, spoiling their fun. The first man Rittenhouse killed, Joseph Rosenbaum – he’s in the red shirt – had been just released from a mental hospital after a suicide attempt.

Multiple Protests Planned Across US Following Rittenhouse Acquittal, by Tyler Durden

The verdict is in and it was the common sense acquittal on all counts. The case should never have gone to trial. Now of course we get the tantrum. From Tyler Durden at zerohedge.com:

Update (1558ET): Reports suggest multiple protests are planned across the U.S. after the jury decided to acquit Kyle Rittenhouse of all charges.

Twitter account “Raws Alerts” reports protests are being planned in Kenosha, Wisconsin, where the trial was held. National Guard troops are on standby for action if social unrest breaks out.

Comments outside the protest include one individual who said, “when it’s a state-sanctioned murder, you get to riot.”

Other protests are allegedly being planned for Chicago, New York City, Portland, Washington, D.C., Philadelphia, and Los Angeles.

As of 1550 ET, there are no reports of protests or riots in any mentioned cities. This is something readers should keep a close eye on into the evening and overnight.

Update (1500ET): When asked for his opinion on the verdict, President Biden said he “stands by” the jury’s decision to acquit Rittenhouse, adding “the jury system works and we have to abide by it.”
