The Takeover of America’s Legal System, by Aaron Sibarium

A lot of trendy academic notions like Critical Race Theory are working their way into the legal system at the expense of non-trendy notions like equal justice and due process. From Aaron Sibarium at bariweiss.substack.com:

(Tom Williams/CQ Roll Call)

If you are a Common Sense reader, you are by now highly aware of the phenomenon of institutional capture. From the start, we have covered the ongoing saga of how America’s most important institutions have been transformed by an illiberal ideology—and have come to betray their own missions.

Medicine. Hollywood. Education. The reason we exist is because of the takeover of newspapers like The New York Times.

Ok, so we’ve lost a lot. A whole lot. But at least we haven’t lost the law. That’s how we comforted ourselves. The law would be the bulwark against this nonsense. The rest we could work on building anew.

But what if the country’s legal system was changing just like everything else?

Today, Aaron Sibarium, a reporter who has consistently been ahead of the pack on this beat, offers a groundbreaking piece on how the legal system in America, as one prominent liberal scholar put it, is at risk of becoming “a totalitarian nightmare.”

This is a long feature on a subject we think deserves your time. Save it, share it, or print it to read in a quiet moment And please support stories like this one by subscribing today.

In 2017, the super lawyer David Boies was at a corporate retreat at the Ritz-Carlton in Key Biscayne, Florida, hosted by his law firm, Boies, Schiller and Flexner. Boies was a liberal legend: He had represented Al Gore in Bush v. Gore, and, in 2013, successfully defended gay marriage in California, in Hollingsworth v. Perry, paving the way for the landmark Supreme Court ruling two years later.

On the last day of the retreat, Boies gave a talk in the hotel ballroom to 100 or so attorneys, according to a lawyer who was present at the event. Afterwards, Boies’s colleagues were invited to ask questions.

Most of the questions were yawners. Then, an associate in her late twenties stood up. She said there were lawyers at the firm who were “uncomfortable” with Boies representing disgraced movie maker Harvey Weinstein, and she wanted to know whether Boies would pay them severance so they could quit and focus on applying for jobs at other firms. Boies, who declined to comment for this article, said no.

That lawyers could be tainted by representing unpopular clients was hardly news. But in times past, lawyers worried about the public—not other lawyers. Defending communists, terrorists, and cop killers had never been a crowd pleaser, but that’s what lawyers had to do sometimes: Defend people who were hated.

Please Stop Trusting Anything The Mainstream Media ‘Report’, by the I & I Editorial Board

It’s been slow in coming, but millions of Americans now realize that the mainstream media is full of shit. From the Issues and Insights editorial board at issuesinsights.com:

pxhere.com

America’s mainstream, or legacy, media have an agenda. It’s not to subjectively report the truth but to further leftist ideas and policies, all of which are toxic. The press’ disinformation campaign to prop up critical race theory is yet another example of its effort to deceive, manipulate, and divide on behalf of the party it is constantly shilling for.

A new study from the American Enterprise Institute found the media focus on schools teaching the history of slavery and racism, and largely ignore the “bedrock assumptions of CRT, including its explicit rejection of rationality and objectivity.”

AEI’s Frederick M. Hess “examined all news accounts addressing CRT published over a one-year period by four major newspapers (the New York Times, Washington Post, Wall Street Journal, and USA Today),” and several “influential education press outlets.” All are news accounts. None are opinion pieces.

“Given that this admittedly revolutionary worldview is what motivates many objections to CRT-influenced pedagogy, one would expect news accounts to routinely address it,” Hess writes in “Media’s Misleading Portrayal of the Fight over Critical Race Theory.”

“Remarkably, however, CRT’s guiding assumptions were rarely mentioned in mainstream media or education press news accounts.”

Continues Hess:

Only a tiny sliver of news accounts even mentioned the substantive concerns about CRT or sought to explore the actual tensions. This is a grave disservice to parents, communities, and educators interested in finding productive ways to debate these heated issues.

Media bias has also infected coverage of the Kyle Rittenhouse trial, which is now in the jury deliberation stage. The bias has been so severe that several on the left are “now willing to admit they were duped” by the press’ Rittenhouse reporting, says Legal Insurrection.

Woke Gets Whacked — But Hold the Victory Lap, by James Howard Kunstler

James Howard Kunstler shreds Critical Race Theory and vaccine propaganda. From Kunstler at kunstler.com:

It begins to look like the 2021 elections put a decisive end to the Woke-Jacobin-Progressive reign-of-terror, and its demonic efforts to cancel the authority of truth in human affairs — truth being derived from reality. For years, in an ever-escalating campaign of coercion, persecution, and punishment, the WJPs made their own reality-optional “truth” and foolishly expected the nation to roll over for it. On Tuesday, voters all over the land, in effect, whapped the Party of Chaos upside its head with thirty inches of No. 6 rebar and said “no more.” Days later, he Wokesters are still seeing stars and planets blink in their temporal lobes.

The Virginia governor’s contest illustrated plainly and clearly what was at issue, all crystalized in the Loudoun County School Board’s idiotic behavior this past year. First was the sex module of the mess: A fifteen-year-old boy pretending to be a girl in a dress raped an actual teenage girl in a “Girls’” bathroom. The Loudoun County School Board covered it up so as not to interfere with its innovative gender confusion pedagogy. The boy rapist was transferred to another school where he committed the same crime all over again. Very bad optics. And WJP candidate Terry McAulliffe told parents to stay out of it, stupidly driving a stake through his own heart in the process.

Second was the Woke race module, namely Critical Race Theory, the principle that American society is hopelessly and systemically racist and that white people need to be punished for it. The School Board and its political allies denied that this doctrine of Marxist identity politics was being worked into the curriculum. They were lying, of course, and stupidly, because it was very easy to prove.

‘Teaching Kids About Race & Gender? by Chris Sweeney

Criticizing any of the garbage that nowadays passes for education at a school board meeting makes one a domestic terrorist. The U.S. needs a lot more of such domestic terrorism. From Chris Sweeney at lewrockwell.com:

The teaching of critical race theory’s a controversial topic for many US schools, and one parent’s seemingly innocuous enquiry about it has really lifted the lid on the whole can of worms.

Four months ago, Rhode Island mom Nicole Solas, 38, asked the principal of her child’s kindergarten whether the kids would be learning about critical race theory (CRT). Not all parents in the US are happy about its being taught, with some being concerned it focuses on skin colour rather than individual merit, and thereby creates the very institutional racism its teaching is supposed to eradicate.

Solas’ concerns, however, went deeper. She also asked the principal whether the children were going to learn about gender theory.

And it turns out they would be,” she told RT. “They said they don’t call kids ‘boys’ and ‘girls’, and they don’t use gendered terminology. [As for] the First Thanksgiving, they ask kids what could have been done differently.”

When Solas pressed for more detail, she was told to submit public records requests. She believed it was all just part of the bureaucratic process, but things changed when she filed her paperwork.

My school then threatened to sue me, as they thought I’d submitted too many requests. They bullied and harassed me in a public meeting. They treated me like I was having a show trial and ultimately decided not to sue me,” she explained. “But then a month or so later, the National Education Association, which is the largest teachers’ union in America, did sue me. They’re suing me to prevent the disclosure of public information that would come out of my public records requests, as they’re claiming teachers are going to be harassed if we know they are teaching CRT.

A court hearing has been scheduled for December. However, for Solas, that was only the start, as she felt allegations had been made about her character on American TV. As a result, she moved her daughter to a private Catholic school. She said, “I made a decision to remove her from public school the moment my school hired a PR firm to defame me in the national media and imply that I’m racist on Fox News.

Conflict Of Interest? AG Garland’s Family Getting Rich Selling Critical Race Theory Materials To Schools, by Tyler Durden

This one isn’t quite as rancid as Joe and Hunter Biden’s corruption, but it’s certainly odiferous. From Tyler Durden at zerohedge.com:

When it comes to conflicts of interest, Attorney General Merrick Garland appears to have a huge one.

Merrick’s daughter, Rebecca Garland, is married to the co-founder of an education resource company that pushes critical race theory – which angry parents across the country are protesting. Taking matters into his own hands, AG Garland tapped the FBI on Monday to huddle with local leaders to address a “disturbing spike in harassment, intimidation, and threats of violence” against teachers and school board members.

As the Conservative Treehouse writes:

Well, well, well… This is interesting.  U.S. Attorney General Merrick Garland recently instructed the FBI to begin investigating parents who confront school board administrators over Critical Race Theory indoctrination material. The U.S. Department of Justice issued a memorandum to the FBI instructing them to initiate investigations of any parent attending a local school board meeting who might be viewed as confrontational, intimidating or harassing.

Attorney General Merrick Garland’s daughter is Rebecca Garland.  In 2018 Rebecca Garland married Xan Tanner [LINK].  Mr. Xan Tanner is the current co-founder of a controversial education service company called Panorama Education. [LINK and LINK]  Panorama Education is the “social learning” resource material provider to school districts and teachers that teach Critical Race Theory.

Conflict of interest much?

Yes, the Attorney General is instructing the FBI to investigate parents who might pose a financial threat to the business of his daughter’s husband.

The Great Parent Revolt, by Katharine C. Gorka

One thing the coronavirus commissars didn’t count on was that locked at home parents would have a lot more time to see what their kids were studying in school. A lot of parents haven’t liked what they’ve seen, and they’re doing something about it. From Katharine C. Gorka at realclearpolitics.com:

The Great Parent Revolt

As overreach in classrooms by progressive school administrators, nonprofits and the federal government has reached new heights, parents are stepping up to fight back.

Moms for Liberty, Informed Parents of California, EdFirstNC, NJ Parental Rights, No Left Turn in Education and Parents Against Critical Theory are just a few of the hundreds of new parent groups that have emerged across the country in recent months. Many parents have become education activists because of schools’ failure to bring children back into the classroom or their continued imposition of mask mandates.

Others are engaging because of the content being taught. Whether it’s age-inappropriate sex education, critical race theory, or anti-American history, parents are seeing more of what their children are learning—thanks to COVID’s virtual learning—and they don’t like it. As a result, parents are organizing, speaking out, and pushing back, and they are having a noticeable impact.

Some of the most effective efforts have begun with individual parents who reached a boiling point and decided to speak out. Mom and investigative journalist A.P. Dillon helped expose critical race theory training in Wake County, N.C., public schools.  Elana Fishbein was a lone parent in Lower Marion, Pa., who objected to content in her children’s curriculum, which, in her words, “described ‘whiteness’ as an entitlement to steal land, garner riches, and get special treatment on equity and race.” That letter reached a national audience when Tucker Carlson invited her onto his Fox News Channel show.

Do Students in the U.S. Have a Constitutional Right NOT to Be ‘Captive Audiences’ to Left-Wing Ideology? by Robert Bridge

We all know about free speech, but do people have a right not to be forced to listen to something, especially when it’s under the auspices of the government? Of course the real answer to all this is to completely privatize education and people can stick there kids in classes of which they approve. From Robert Bridge at strategic-culture.org:

Around the country, furious parents are speaking out against their children being indoctrinated with the latest madness.

There’s a war on for the hearts and minds of children across the U.S. and the battlefield has become the very schools that millions of Americans are required to send their kids for a state-run education. But just as everyone has a constitutional right to speak their mind, members of the audience should never be forced to listen against their will.

In addition to the everyday worries over the physical safety of our children are concerns over their mental wellbeing, a subject that at one time could be largely taken for granted. No more. It’s no secret that many schools are subjecting children to lessons on transgender and alternative sexual lifestyles, as well as the racist ideology of critical race theory.

For millions of Americans on both sides of the political divide, these teachings are ideological heresies that have absolutely no place in the classroom. And make no mistake, people are no longer passively accepting the agenda. In school board meetings around the country, furious parents are speaking out against their children being indoctrinated with the latest madness to escape from the liberal laboratory of social engineering. Yet such teachings are already entrenched into the curriculum and will not go away without a major struggle.

Critical Race Theory Should Be Banned, and a Black Parent Explains Why, by Michael Mish Shedlock

That critical race theory (CRT) is being taught in schools is more an indictment of our virtually monolithic educational establishment than of CRT. Privatize education completely and that small number of students and their parents who want CRT will get it and those who don’t won’t. From Michael Mish Shedlock at mishtalk.com:

This School Board Has Failed!

The best case ever against critical race theory is in the following video, sure to go viral.

Partial Transcript – Emphasis Mine

I’ve got two children her in the school district. It’s very apparent here by all the parents who have spoken, that this board and the school district is failing. More importantly, about Critical Race Theory, this theory was never meant to be brought into grade schools, high schools at all.

It’s actually taught in the collegiate atmosphere, more importantly, the legal portion of the collegiate atmosphere to see different laws through the lens of race from an ethics and ethical standpoint, not for grade schools and high schools.

Instead, educators use it as their own agenda, to indoctrinate the kids to hate each other. And whether you believe that or not, the reality is that is what’s happening.

Critical Race Theory is teaching us that white people are bad. That’s not true. That would teach my daughter that her mother is evil.

The Disney Corp. has taken a deep dive into race-hatred, by Andrea Widburg

It’s no surprise that Disney has gone full “woke,” critical race theory and all. It is in Hollywood (well, Burbank) and its employees are predominately liberal Democrats. From Andrea Widburg at americanthinker.com:

Going back to the late 1920s, every single child raised in America has intersected in some way with products from Walt Disney: we’ve watched the movies and TV shows, sung the songs, worn the clothes, and visited the theme parks.  Through it all, Disney stood for wholesome family entertainment.  That is no longer the case.  Disney is a hardcore leftists corporation that is pushing its politics on children and training its employees to be white-hating racists or self-loathing white people.  It’s time to give up Disney.

During Walt Disney’s tenure, his company also generated propaganda.  Behind all the wonderful entertainment, the company was pushing several themes: heterosexual love is real, the nuclear family matters, American patriotism is important, and God is a beneficent presence in our lives.

Many parents and grandparents buying Disney videos for their children or taking family trips to the theme parks operate under the mistaken impression that this is still the case.  They’re half right.  Disney is still generating propaganda, but it’s about race and sex in ways many parents may not support.

Just the other day, we learned that Disney’s Pixar is planning to introduce a so-called “transgender” girl character for its next Toy Story movie.  That means it is going to have a boy who thinks he’s a girl as a character in a movie aimed at little children.  Disney’s also focused on gay characters in Onward and Out.

Illinoisans Overwhelmingly Oppose Racial Indoctrination Rampant In Schools, Yet They Cower In Silence, by Mark Glennon

It’s not easy to take on the mob. From Mark Glennon at wirepoints.com:

Illinois’ political establishment is far out of touch with the general public on the racial dogma now forced on students from kindergarten through college. Yet a stunning two-thirds of Illinoisans say they don’t speak up, thereby ceding control to an intolerant, extremist minority.

The proof is in a poll released last month that was mostly buried and ignored by the press. It primarily addressed what schools now teach as unquestionable truth: critical race theory, also called anti-racism or wokism.

Illinoisans don’t like it. The American Council of Trustees and Alumni, which commissioned the poll, summarized their findings this way:

A majority  of respondents  favor equipping teachers to develop core skills and competencies over the encouragement of  progressive  political activism.  Illinoisans  also  favor  a curriculum that  focuses  on “American founding principles and . . . documents” over  one that  incorporates  key  tenets of the  New York Times’ 1619  Project.  At  the post secondary level,  strong  majorities  oppose reducing police presence on campus;  support viewpoint diversity; favor a merit-based application process;  and  prioritize  reducing the cost of tuition over expanding  diversity  and equity  programs.

That’s completely at odds with mandates from the state’s politicians and education officials. The Illinois State Board of Education recently approved woke teaching standards with its “Culturally Responsive Teaching and Learning Standards” for K-12 education, and the state earlier made “implicit bias” training required by law for Illinois teachers.
